UU."},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Los Institutos Nacionales de Salud de los EE. UU (NIH) son la mayor agencia de financiaci\u00f3n de investigaci\u00f3n biom\u00e9dica en el mundo y se estima que EE.&nbsp;UU. es uno de los pa\u00edses donde se usan m\u00e1s animales en experimentaci\u00f3n,<sup data-fn=\"d19ebd74-5b39-4d2e-b92f-43109ef4f45b\" class=\"fn\"><a href=\"#d19ebd74-5b39-4d2e-b92f-43109ef4f45b\" id=\"d19ebd74-5b39-4d2e-b92f-43109ef4f45b-link\">1<\/a><\/sup> pero la falta de informaci\u00f3n transparente en este sentido hace imposible conocer las cifras exactas. A pesar de que existen leyes y comit\u00e9s destinados a proteger a los animales en los laboratorios, ning\u00fan experimento est\u00e1 prohibido sin importar cu\u00e1nto da\u00f1o cause. Marcos \u00e9ticos anticuados e incompletos, normas de cuidado y bienestar insuficientes, aplicaci\u00f3n laxa de las regulaciones, comit\u00e9s inoperantes y la exclusi\u00f3n del 95% al 99% de los animales usados en experimentaci\u00f3n<sup data-fn=\"23039f2a-3543-4e7b-a4ff-680a2e00b77a\" class=\"fn\"><a href=\"#23039f2a-3543-4e7b-a4ff-680a2e00b77a\" id=\"23039f2a-3543-4e7b-a4ff-680a2e00b77a-link\">2<\/a><\/sup> de la normativa aplicable definen la realidad del uso de animales en los laboratorios estadounidenses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Ley Federal de Bienestar Animal (AWA, por sus siglas en ingl\u00e9s) y la Ley de Extensi\u00f3n de la Investigaci\u00f3n Sanitaria de&nbsp;1985 (HREA) son las \u00fanicas dos leyes federales que establecen est\u00e1ndares m\u00ednimos para el trato de los animales en los laboratorios de EE.&nbsp;UU. Ambas leyes son deficientes y existen problemas cr\u00edticos que dificultan su eficacia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La AWA no cubre a la gran mayor\u00eda de los animales usados en laboratorios de EE.&nbsp;UU. Esto incluye aproximadamente 111&nbsp;millones de ratas y ratones<sup data-fn=\"28b03190-6304-4fed-a4b4-4b6297f0d13b\" class=\"fn\"><a href=\"#28b03190-6304-4fed-a4b4-4b6297f0d13b\" id=\"28b03190-6304-4fed-a4b4-4b6297f0d13b-link\">3<\/a><\/sup> y millones de peces, cangrejos herradura, ranas, cefal\u00f3podos, tortugas, aves criadas con fines espec\u00edficos y otros animales criados como fuente de alimentaci\u00f3n y fibra, quienes no est\u00e1n reconocidos como \u201canimales\u201d por la ley.<sup data-fn=\"504cc1f7-45fb-49e2-965d-1671e48e628f\" class=\"fn\"><a href=\"#504cc1f7-45fb-49e2-965d-1671e48e628f\" id=\"504cc1f7-45fb-49e2-965d-1671e48e628f-link\">4<\/a><\/sup> Mientras tanto, la HREA solo se aplica a las instituciones que reciben financiaci\u00f3n de los contribuyentes proveniente de las agencias federales de salud de EE.&nbsp;UU., como los NIH,<sup data-fn=\"7471da75-2a2f-4c43-a286-15d9f75c9d7c\" class=\"fn\"><a href=\"#7471da75-2a2f-4c43-a286-15d9f75c9d7c\" id=\"7471da75-2a2f-4c43-a286-15d9f75c9d7c-link\">5<\/a><\/sup> lo que deja sin protecci\u00f3n legal a los animales usados en instituciones financiadas por otras fuentes. Aunque algunos estados de EE.&nbsp;UU. tienen leyes contra la crueldad hacia los animales, la mayor\u00eda excluye a aquellos usados en experimentaci\u00f3n.<sup data-fn=\"e4b23c8c-66e3-488a-9c7d-8aca6806b32e\" class=\"fn\"><a href=\"#e4b23c8c-66e3-488a-9c7d-8aca6806b32e\" id=\"e4b23c8c-66e3-488a-9c7d-8aca6806b32e-link\">6<\/a><\/sup><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ninguna de las dos leyes federales obliga a los experimentadores a evitar el uso innecesario de animales o a contemplar la posibilidad de sustituirlos por un m\u00e9todo sin animales, sino solo a haber <em>considerado<\/em> alternativas a los procedimientos nocivos espec\u00edficos que planean llevar a cabo. Sin embargo, el requisito de buscar procedimientos que causen menos da\u00f1o o angustia no se hace cumplir de manera consistente.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mejorar la supervisi\u00f3n reducir\u00eda significativamente el da\u00f1o a los animales, pero no resolver\u00eda el problema. Abandonar por completo el uso de animales eliminar\u00eda la necesidad de una regulaci\u00f3n m\u00e1s estricta de su uso y proteger\u00eda el bienestar tanto de los humanos como de otros animales.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><strong>Autorizaci\u00f3n negligente: los Comit\u00e9s Institucionales para el Cuidado y Uso de Animales en EE. UU.<\/strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Los Comit\u00e9s Institucionales para el Cuidado y Uso de Animales (IACUC), creados en EE. UU. como respuesta al clamor p\u00fablico por los casos de crueldad contra los animales confinados en laboratorios, se establecieron con la intenci\u00f3n de garantizar que las instituciones que usan animales en experimentaci\u00f3n cumplieran la AWA. Se esperaba \u201cque instancias como [estos] comit\u00e9s \u00e9ticos asumieran la responsabilidad social corporativa actuando como vigilantes de los experimentos en animales\u201d.<sup data-fn=\"7bfa2705-1943-4388-903b-e91d9d02249f\" class=\"fn\"><a href=\"#7bfa2705-1943-4388-903b-e91d9d02249f\" id=\"7bfa2705-1943-4388-903b-e91d9d02249f-link\">7<\/a><\/sup><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En la pr\u00e1ctica, los IACUC carecen de la diversidad \u00e9tica y cient\u00edfica necesaria para abordar con eficacia la creciente preocupaci\u00f3n por el bienestar animal y la capacidad de evitar el uso de animales.<sup data-fn=\"27f7ec4d-2619-4f27-baec-6aa478d2b578\" class=\"fn\"><a href=\"#27f7ec4d-2619-4f27-baec-6aa478d2b578\" id=\"27f7ec4d-2619-4f27-baec-6aa478d2b578-link\">8<\/a><\/sup> Un estudio publicado en 2012 revel\u00f3 que, en promedio, los miembros de los IACUC en las principales instituciones financiadas por los NIH eran predominantemente experimentadores en animales.<sup>83<\/sup> De acuerdo con dicho estudio, la \u201cabrumadora presencia de investigaci\u00f3n en animales e intereses institucionales puede diluir el aporte de los pocos miembros de los IACUC que representan el bienestar animal y al p\u00fablico en general, contribuir al sesgo previamente documentado del comit\u00e9 a favor de la aprobaci\u00f3n de experimentos en animales y reducir la objetividad y eficacia general del sistema de supervisi\u00f3n\u201d.<sup data-fn=\"97f2d4e2-9cd0-4c39-81d9-e60240ed8645\" class=\"fn\"><a href=\"#97f2d4e2-9cd0-4c39-81d9-e60240ed8645\" id=\"97f2d4e2-9cd0-4c39-81d9-e60240ed8645-link\">9<\/a><\/sup><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La ambig\u00fcedad del lenguaje legislativo y la escasa supervisi\u00f3n de los IACUC han generado incoherencias en la implementaci\u00f3n y la eficacia. M\u00faltiples auditor\u00edas de la Oficina del Inspector General de los EE. UU. (OIG) y encuestas internas han demostrado las deficiencias de los IACUC:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>En&nbsp;1995, la OIG descubri\u00f3 que los IACUC no pod\u00edan garantizar que los experimentadores buscaran alternativas a procedimientos da\u00f1inos ni que los estudios propuestos no duplicaran innecesariamente experimentos anteriores.<sup data-fn=\"9fc3f4b3-eeda-4a9d-a6ee-f85c5a779a63\" class=\"fn\"><a href=\"#9fc3f4b3-eeda-4a9d-a6ee-f85c5a779a63\" id=\"9fc3f4b3-eeda-4a9d-a6ee-f85c5a779a63-link\">10<\/a><\/sup><\/li>\n\n\n\n<li>Una encuesta realizada en el a\u00f1o&nbsp;2000 por el Departamento de Agricultura de EE.&nbsp;UU. (USDA) a los inspectores de laboratorios de la agencia encontr\u00f3 que el \u00e1rea m\u00e1s problem\u00e1tica para los IACUC era la b\u00fasqueda de alternativas a procedimientos da\u00f1inos, y revel\u00f3 que \u201centre 600&nbsp;y 800&nbsp;instalaciones han tenido problemas con la b\u00fasqueda de alternativas\u201d. Los inspectores del USDA tambi\u00e9n consideraron que la \u201cinfluencia indebida\u201d de los investigadores principales era un problema para los IACUC.<sup data-fn=\"9eef8d39-1ee6-4f17-89e9-96760462e40d\" class=\"fn\"><a href=\"#9eef8d39-1ee6-4f17-89e9-96760462e40d\" id=\"9eef8d39-1ee6-4f17-89e9-96760462e40d-link\">11<\/a><\/sup><\/li>\n\n\n\n<li>En 2005, la OIG public\u00f3 un informe de auditor\u00eda en el que volvi\u00f3 a resaltar estas dificultades y se\u00f1al\u00f3 los continuos \u201cproblemas con la b\u00fasqueda de alternativas de investigaci\u00f3n, la atenci\u00f3n veterinaria, la revisi\u00f3n de procedimientos dolorosos y el uso de animales por parte de los investigadores\u201d.<sup data-fn=\"8e988e08-98f7-4149-a34a-7e182d0e577e\" class=\"fn\"><a href=\"#8e988e08-98f7-4149-a34a-7e182d0e577e\" id=\"8e988e08-98f7-4149-a34a-7e182d0e577e-link\">12<\/a><\/sup><\/li>\n\n\n\n<li>En la auditor\u00eda publicada en 2014, la OIG advirti\u00f3 que los IACUC \u201cno siempre supervisan adecuadamente los procedimientos experimentales en animales\u201d, lo que resulta en una \u201cgarant\u00eda reducida de que los protocolos se completen, aprueben y cumplan correctamente, y que los animales siempre reciban cuidados y tratamientos compasivos b\u00e1sicos\u201d.<sup>87<\/sup> Estos resultados coinciden con los hallazgos del USDA: entre 2009&nbsp;y&nbsp;2011, sus inspectores documentaron 1379&nbsp;infracciones en 531&nbsp;instalaciones relacionadas con la revisi\u00f3n y supervisi\u00f3n inadecuadas del uso de animales por parte de los IACUC.<sup data-fn=\"6451b1a6-e6eb-475e-870b-bd15cd27027f\" class=\"fn\"><a href=\"#6451b1a6-e6eb-475e-870b-bd15cd27027f\" id=\"6451b1a6-e6eb-475e-870b-bd15cd27027f-link\">13<\/a><\/sup><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Muy poco ha cambiado desde entonces. La iniciativa m\u00e1s reciente de los NIH para mejorar tanto el rigor como la reproducibilidad en la investigaci\u00f3n no abord\u00f3 los innumerables problemas con los IACUC y sus procesos de revisi\u00f3n.<sup data-fn=\"4052dae0-77f3-4f95-8f32-0c9599b05ff4\" class=\"fn\"><a href=\"#4052dae0-77f3-4f95-8f32-0c9599b05ff4\" id=\"4052dae0-77f3-4f95-8f32-0c9599b05ff4-link\">14<\/a><\/sup><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Una de las principales fallas en la supervisi\u00f3n de los experimentos en animales en EE. UU. es que no hay ning\u00fan punto en el proceso de aprobaci\u00f3n de protocolos en el que se considere el da\u00f1o que sufrir\u00e1n los animales frente a los beneficios esperados de la investigaci\u00f3n. Aunque las instancias de supervisi\u00f3n afirman adherirse a las pol\u00edticas que exigen la realizaci\u00f3n de un an\u00e1lisis de da\u00f1os y beneficios,<sup data-fn=\"9a4bd2a9-5532-4883-a15a-ce791c7b2a28\" class=\"fn\"><a href=\"#9a4bd2a9-5532-4883-a15a-ce791c7b2a28\" id=\"9a4bd2a9-5532-4883-a15a-ce791c7b2a28-link\">15<\/a><\/sup><sup data-fn=\"df589ec4-7ad7-46b0-b32c-cc4b7f6a8b06\" class=\"fn\"><a href=\"#df589ec4-7ad7-46b0-b32c-cc4b7f6a8b06\" id=\"df589ec4-7ad7-46b0-b32c-cc4b7f6a8b06-link\">16<\/a><\/sup> quienes eval\u00faan el da\u00f1o son distintos a quienes eval\u00faan el beneficio, y no hay ning\u00fan intento de equilibrar sus decisiones. Los IACUC revisan el da\u00f1o que se infligir\u00e1 a los animales cubiertos por la AWA o incluidos en protocolos financiados por los NIH, mientras que los comit\u00e9s de financiaci\u00f3n eval\u00faan el posible beneficio de los experimentos para el \u00e1rea de investigaci\u00f3n. Estos comit\u00e9s funcionan de distinta forma, no comparten sus opiniones entre s\u00ed y solo emiten decisiones dicot\u00f3micas (aprobado o rechazado), lo que da lugar a un sistema de evaluaci\u00f3n fragmentado e incompleto.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Las <strong>3Rs <strong>son insuficientes<\/strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Las 3R (reemplazo, reducci\u00f3n y refinamiento del uso de animales) han sido durante mucho tiempo el marco \u00e9tico que ha guiado el uso de animales en la investigaci\u00f3n biom\u00e9dica en todo el mundo. Introducidas por William Russell y Rex Burch en su libro de&nbsp;1959, <em>The Principles of Humane Experimental Technique<\/em>,<sup data-fn=\"e08670a9-3b66-42c9-b7ef-678386e0aa1c\" class=\"fn\"><a href=\"#e08670a9-3b66-42c9-b7ef-678386e0aa1c\" id=\"e08670a9-3b66-42c9-b7ef-678386e0aa1c-link\">17<\/a><\/sup> las 3R han sido fuertemente criticadas en los \u00faltimos a\u00f1os por su incapacidad para evitar da\u00f1os innecesarios a los animales, dado que su enfoque se limita a la \u00e9tica procedimental, en lugar de abordar los problemas sociales y morales m\u00e1s amplios en torno a la investigaci\u00f3n en animales. Algunos expertos sostienen que los principios no abordan adecuadamente la complejidad del bienestar animal y las consideraciones \u00e9ticas en la investigaci\u00f3n.<sup data-fn=\"f7aee9f4-aacc-4ca8-97b8-81b0c42b3196\" class=\"fn\"><a href=\"#f7aee9f4-aacc-4ca8-97b8-81b0c42b3196\" id=\"f7aee9f4-aacc-4ca8-97b8-81b0c42b3196-link\">18<\/a><\/sup><sup data-fn=\"99f80d51-a6ad-4179-961d-2a74e7f25497\" class=\"fn\"><a href=\"#99f80d51-a6ad-4179-961d-2a74e7f25497\" id=\"99f80d51-a6ad-4179-961d-2a74e7f25497-link\">19<\/a><\/sup><sup data-fn=\"c39d1644-b5c6-4def-8f68-4c1ddde154a6\" class=\"fn\"><a href=\"#c39d1644-b5c6-4def-8f68-4c1ddde154a6\" id=\"c39d1644-b5c6-4def-8f68-4c1ddde154a6-link\">20<\/a><\/sup> Otros argumentan que, aunque las 3R hayan sido adecuadas para su \u00e9poca, la ciencia ha avanzado mucho desde su concepci\u00f3n, lo que hace necesaria una actualizaci\u00f3n.<sup data-fn=\"83f4ad0c-f0bc-4043-9775-65ddbfad2cdd\" class=\"fn\"><a href=\"#83f4ad0c-f0bc-4043-9775-65ddbfad2cdd\" id=\"83f4ad0c-f0bc-4043-9775-65ddbfad2cdd-link\">21<\/a><\/sup><sup data-fn=\"00f3eb1c-87dc-46d2-94ba-f9c43d29a25f\" class=\"fn\"><a href=\"#00f3eb1c-87dc-46d2-94ba-f9c43d29a25f\" id=\"00f3eb1c-87dc-46d2-94ba-f9c43d29a25f-link\">22<\/a><\/sup><sup data-fn=\"ace48420-91fc-4ba0-b75a-57b4dc03dcfe\" class=\"fn\"><a href=\"#ace48420-91fc-4ba0-b75a-57b4dc03dcfe\" id=\"ace48420-91fc-4ba0-b75a-57b4dc03dcfe-link\">23<\/a><\/sup><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lo que est\u00e1 claro es que las 3R no han tenido \u00e9xito. En contrav\u00eda de los principios de reducci\u00f3n y refinamiento, actualmente se usan m\u00e1s animales en experimentaci\u00f3n que cuando se public\u00f3 el modelo de las 3R<sup data-fn=\"a62ea74d-8653-46c6-aa6b-826e159b09e3\" class=\"fn\"><a href=\"#a62ea74d-8653-46c6-aa6b-826e159b09e3\" id=\"a62ea74d-8653-46c6-aa6b-826e159b09e3-link\">24<\/a><\/sup><sup data-fn=\"3db7efae-1c5b-4c27-8e71-925f4b20ec68\" class=\"fn\"><a href=\"#3db7efae-1c5b-4c27-8e71-925f4b20ec68\" id=\"3db7efae-1c5b-4c27-8e71-925f4b20ec68-link\">25<\/a><\/sup><sup data-fn=\"ddb40128-e2c0-408a-b7d7-3195d4d5b819\" class=\"fn\"><a href=\"#ddb40128-e2c0-408a-b7d7-3195d4d5b819\" id=\"ddb40128-e2c0-408a-b7d7-3195d4d5b819-link\">26<\/a><\/sup><sup data-fn=\"f988bde9-6b5a-44a6-93b5-935cdfd8bf73\" class=\"fn\"><a href=\"#f988bde9-6b5a-44a6-93b5-935cdfd8bf73\" id=\"f988bde9-6b5a-44a6-93b5-935cdfd8bf73-link\">27<\/a><\/sup> y se siguen usando en procedimientos angustiantes y da\u00f1inos.
